A 65-year-old man, Richard Henry Patterson, accused of killing his lover wants a court in Florida, United States, US, to allow him present his “penis” as proof that his girlfriend died by choking while performing oral sex.
Patterson of Margate in Broward County, Florida, United States filed a motion asking the judge to allow him to show his penis to the jury to prove that Francisca Marquinez died while giving oral sex.
The accused person, in the motion, names a former Broward County medical examiner, Dr. Ronald Wright, as an expert witness who can testify that the death of his lover was caused by “accidentally sexually asphyxiated during oral sex.”
Patterson’s lawyer, Ken Padowitz urged the court to grant the application because it is key to his argument and could prove that Marquinez died while engaged in consensual sexual activity.
The motion reads, partly: “Dr. (Ronald) Wright, an expert witness and former Broward County medical examiner, will testify that … her death is consistent with being accidentally sexually asphyxiated during oral sex.
“It is material and relevant. The view by the jury is essential for them to fully understand Dr. Wright’s testimony and the defense in this case.”
