The court had earlier in its judgment delivered on May 4, 2015 ordered that Okoyomon be detained at the facility of the Economic and Financial Crimes Commission pending his extradition to face corruption charges in the United Kingdom.
Apparently not satisfied with the judgment, the embattled former Director approached the Court of Appeal and prayed it to set aside the judgment.
He then followed his action with a motion for stay of execution filed by his counsel, Dr. Alex Izinyon (SAN).
When the motion came up on Monday, his counsel, A.K. Abu, from the chamber of Alex Izinyon, informed the court of his readiness to move his motion for stay of execution of the judgment of the court pending the determination of the appeal.
He further told Justice Evoh Chukwu, the presiding judge, that the appellate court has already fixed May 28, 2015 for the appeal to be mentioned and has equally served the processes to the respondent.
However, in his response, the prosecution counsel, Muslim Hassan, said he was not aware of any pending appeal by the applicant and was yet to be served with any of such processes.
At that stage, the court directed that he should be served right there in court and it was done.
But the prosecution counsel requested for an adjournment to enable him study the processes and file his response.
Hassan informed the court that the Economic and Financial Crimes Commission had complained that the applicant, who was in its custody, be moved to prison custody as it has no space to further accommodate him.
The court granted the request and ordered that Okoyomon be moved to prison custody and adjourned the case indefinitely.
In a letter of request sent to the Attorney General of the Federation and Minister of Justice, Okoyomon is said to be wanted in the United Kingdom for his alleged role in the bribery scandal involving officials of the Central Bank of Nigeria, the NSMPC and Securency International Pty of Australia between 2006 and 2008.
